Sheppard
put a lot of information in to the court bundle pointing to
allegations of police misconduct. However Mr Coulters claim
against the Chief Constable made no allegation of wrongdoing.
The original proceedings were a straight forward claim for negligence,
in that the police were told that the car was not at Britannia
Motors, (it was later found by Mr Coulter in a boarded up building
60m behind Britannia Motors), not only was it being concealed,
but the car dealer Stuart Burke, that we now know had a brother
who was a serving Dorset Police Officer, and Stuart was bragging
to Mr Coulter that he would never get the car back, and that
Burke would chop it up and sell the pieces, if Mr Coulter attempted
legal action for recovery. The Police had the power to inmpound
this car under section 19 of PACE, the Deputy Chief Constable
had an LLB in law, and knew this. However both he and the county
council lawyer Mike Davies both lied about the power thay had
to impound the car. Britannia Motors was a large car park with
2 glass buildings, one a workshop, the other the office. Nowhere
on the Britannia Motors site could this Jeep be unseen.
